  • Organization receiving notification of foreign investment & required documents
    • Applicant: Foreign investor (power of attorney)
    • Organizations receiving the notification of foreign investment (depository institutions)
      • Invest KOREA, or KOTRA's domestic and overseas trading centers
      • Headquarter or branches of foreign exchange banks in Korea, designated domestic branches of foreign banks
    • Documents
      • Two copies of the notification form for foreign investment by type (acquisition of new stocks, acquisition of existing stocks, long-term loans, etc.)
      • Document proving the nationality of the foreign national
      • In the event that the foreign national is a corporation or group: A certificate of corporate registration issued by the government or other authorities, or documents proving that the corporation or group is situated in that country.
      • In the event that the foreign national is an individual: A document proving the nationality of the foreign national, including a citizenship certificate or passport, issued by the government or other authorities of the country of the foreign national.
      • However, if the foreign investor holds Korean nationality, documents can be replaced by a permanent residency certificate issued by the government or other authorities of the country of residence, or a certificate of overseas resident registration issued by the head of the Korean embassy and/or legations abroad.
    • Additional documents to be submitted only when deemed necessary
      • Documents on the investment object, documents related to the acquisition of other stocks
      • Form of power of attorney (In the event that power of attorney, under the consent of the foreign investor, has been notified and applied for approval)
  • Remittance of Investment Funds
    • In the process of payment, the bank issues a Certificate of Payment (needed to register the establishment of the corporation) and a Certificate of Purchased Foreign Currency (needed to register as a foreign-invested company).
    • In principle, the investment funds should be remitted under the name of the foreign investor himself/herself, and funds that have been sourced domestically are not acceptable as overseas remittance.
  • Registration of Foreign Investment Company
    • Application deadline: Within 30 days of the day of the relevant event.
    • When foreign investors have completed payment of the investment object (acquisition of new stocks)
    • When foreign investors have completed the payment and completed the acquisition of existing stocks (acquisition of existing stocks)
    • When foreign investors acquired stocks by means of merger (Acquisition of stocks through the use of convertible bonds, divestiture, etc.)
    • Applicant of registration: foreign-invested companies or foreign investors (power of attorney)
